Big question

When a machine makes thousands of ads, who answers for whether each one is true?

The position

Move substantiation, rights clearance and disclosure into the generation step rather than into a review after the volume has already arrived. Disclose where a reasonable person would take the work as a real record of something, and log who approved it either way.

Why it is live

Generation removed the cost of making an asset and left the cost of checking it, and the duty to check falls on the advertiser rather than on the tool. The European Commission updated its transparency guidelines in August 2026, the IAB refreshed its disclosure framework in the same month, and the United States position on copyright still turns on human authorship.

The case that disclosure is required

DocumentedThe statute is in force, and platform enforcement is real and runs daily.

The case that its scope is open

UnknowableThe statute limits the duty where content forms part of an evidently artistic, creative, satirical or fictional work, whether an advertisement is one of those is unresolved, and no enforcement action against an advertiser has been found.

Where the weight sits

The duty is settled and its edge is not. Disclose at the edge, keep the approval record, and do not let anybody tell you the question is closed in either direction.

Evidence DocumentedAgreement Real disagreement. Credible people disagree, and it is not a misunderstandingState Live. Being tracked, and moving

What would change this

The first enforcement action by a national market surveillance authority against an advertiser, or a ruling on whether an advertisement counts as an evidently creative work.
